We run a service called Charity Factors and would love for you to use it. Our service is FREE to use for organizations and individuals. 

The following terms and conditions govern all use of the websites powered by Charity Factors and all content, services and products available at or through the websites (taken together, the Website). The Website is owned and operated by Global Synergy Group LLC in cooperation with Charity Factors Foundation (Reg. Nr. 40008169845), whose registered address is Visvalza 3, Riga, Latvia, European Union. 

The Website is offered subject to your acceptance without modification of all of the terms and conditions contained herein and all other operating rules, policies (including, without limitation, Charity Factors’ Privacy Policy) and procedures that may be published from time to time on this Site by Charity Factors (collectively, the "Agreement").

Please read this Agreement carefully before accessing or using the Website. By accessing or using any part of the web site, you agree to become bound by the terms and conditions of this agreement. If you do not agree to all the terms and conditions of this agreement, then you may not access the Website or use any services. If these terms and conditions are considered an offer by Charity Factors, acceptance is expressly limited to these terms. The Website is available only to individuals who are at least 16 years old.

Your Charity Factors Account. If you create an account on the Website, you are responsible for maintaining the security of your account, and you are fully responsible for all activities that occur under the account and any other actions taken in connection with the account. You must not describe or assign keywords to your account in a misleading or unlawful manner, including in a manner intended to trade on the name or reputation of others, and Charity Factors may change or remove any description or keyword that it considers inappropriate or unlawful, or otherwise likely to cause Charity Factors liability. You must immediately notify Charity Factors of any unauthorized uses of your account or any other breaches of security. Charity Factors will not be liable for any acts or omissions by You, including any damages of any kind incurred as a result of such acts or omissions.

Responsibility of Contributors. If you operate an account, comment on an account, post material to the Website, post links on the Website, or otherwise make (or allow any third party to make) material available by means of the Website (any such material, "Content"), You are entirely responsible for the content of, and any harm resulting from, that Content. That is the case regardless of whether the Content in question constitutes text, graphics, an audio file, or computer software. 

By making Content available, you represent and warrant that:

the downloading, copying and use of the Content will not infringe the proprietary rights, including but not limited to the copyright, patent, trademark or trade secret rights, of any third party;

if your employer has rights to intellectual property you create, you have either (i) received permission from your employer to post or make available the Content, including but not limited to any software, or (ii) secured from your employer a waiver as to all rights in or to the Content;

you have fully complied with any third-party licenses relating to the Content, and have done all things necessary to successfully pass through to end users any required terms;

the Content does not contain or install any viruses, worms, malware, Trojan horses or other harmful or destructive content;

the Content is not spam, is not machine- or randomly-generated, and does not contain unethical or unwanted commercial content designed to drive traffic to third party sites or boost the search engine rankings of third party sites, or to further unlawful acts (such as phishing) or mislead recipients as to the source of the material (such as spoofing);

the Content is not libelous or defamatory (more info on what that means), does not contain threats or incite violence towards individuals or entities, and does not violate the privacy or publicity rights of any third party;

your account is not getting advertised via unwanted electronic messages such as spam or similar unsolicited promotional methods;

your account is not named in a manner that misleads your readers into thinking that you are another person or company or organization. For example, your account’s URL or name is not the name of a person other than yourself or company or organization other than your own; and you have, in the case of Content that includes computer code, accurately categorized and/or described the type, nature, uses and effects of the materials, whether requested to do so by Charity Factors or otherwise.

By submitting Content to Charity Factors for inclusion on Website, you grant Charity Factors a world-wide, royalty-free, and non-exclusive license to reproduce, modify, adapt and publish the Content solely for the purpose of displaying, distributing and promoting your account. If you delete Content, Charity Factors will use reasonable efforts to remove it from the Website, but you acknowledge that caching or references to the Content may not be made immediately unavailable. 

Without limiting any of those representations or warranties, Charity Factors has the right (though not the obligation) to, in Charity Factors’ sole discretion (i) refuse or remove any content that, in Charity Factors’ reasonable opinion, violates any Charity Factors policy or is in any way harmful or objectionable, or (ii) terminate or deny access to and use of the Website to any individual or entity for any reason, in Charity Factors’ sole discretion. 

Responsibility of Website Visitors. Charity Factors has not reviewed, and cannot review, all of the material, posted to the Website, and cannot therefore be responsible for that material’s content, use or effects. By operating the Website, Charity Factors does not represent or imply that it endorses the material there posted, or that it believes such material to be accurate, useful or non-harmful. The Website may contain content that is offensive, indecent, or otherwise objectionable, as well as content  containing technical inaccuracies, typographical mistakes, and other errors. The Website may also contain material that violates the privacy or publicity rights, or infringes the intellectual property and other proprietary rights, of third parties, or the downloading, copying or use of which is subject to additional terms and conditions, stated or unstated. Charity Factors disclaims any responsibility for any harm resulting from the use by visitors of the Website, or from any downloading by those visitors of content there posted. You agree to immediately report any suspicious, dishonest, misleading or fraudulent activity on this site. Charity Factors will investigate all such claims. Any user found to have posted false or misleading information will be banned from further use of this site. Charity Factors reserves the right to remove any user, organization or cause it deems as inappropriate, at its sole discretion.

Content Posted on Other Websites. We have not reviewed, and cannot review, all of the material, including computer software, made available through the websites and webpages to which CharityFactors links, and that link to Charity Factors. Charity Factors does not have any control over those non-Charity Factors websites and webpages, and is not responsible for their contents or their use. By linking to a non- Charity Factors website or webpage, Charity Factors does not represent or imply that it endorses such website or webpage. You are responsible for taking precautions as necessary to protect yourself and your computer systems from viruses, worms, Trojan horses, and other harmful or destructive content. Charity Factors disclaims any responsibility for any harm resulting from your use of non-Charity Factors websites and webpages.

Donations.Charity Factors offers you a way to donate through the Charity Factors website. Charity Factors offers you a way to donate directly to organization's account or through the Charity Factors Foundation. Making donation via PayPal, 100% of the money donated goes directly to specified organization’s PayPal account (Paypal fees apply).  Charity Factors offers organizations to accept donations through Charity Factors Foundation. Within 30 days all funds raised through Charity Factors Foundation in the amount of 85% are sent to the organization implementing the project of your choice. By clicking the "Donate" button when making a donation, you agree to these Terms, including without limitation this section. You understand that this section does not constitute legal or accounting advice, and that you should consult your own tax advisor for information regarding the tax consequences to you of your donation. You understand that the tax rules governing the deductibility of your donation are complex and will differ depending on many factors, including your country of citizenship. You agree that, like any tax-deductible charitable contribution, your donation is non-refundable and cannot be cancelled or returned once it has been completed. Charity Factors is not responsible for any dissatisfaction you may have regarding the recipient organization's use of any donation you may make through the Website or websites powered by Charity Factors. Please note that the recipient organization reserves the right to use your donation for its general purposes. Charity Factors or the cannot guarantee that funds will be earmarked for a particular appeal, unless specifically stated by the recipient organization itself. When a donation is made on the Website the transaction is final and not disputable unless unauthorized use of your payment card is proved. If you become aware of fraudulent use of your card, or if it is lost or stolen, you must notify your card provider in accordance with its reporting rules.

Donor's Responsibility of Due Diligence. While it is the desire of Charity Factors to maintain an accurate and up-to-date database of organizations and their projects, we cannot and do not screen each individual cause and project, nor do we make any warranties about the accuracy or authenticity of any causes and projects. We require all organizations on this site to abide by policies and guidelines. Also, because organizations and projects on this site will be viewed by numerous experienced and discerning donors, it is likely that any counterfeit proposals would be detected quickly. Charity Factors will investigate all such reports of abuse from its users. Any organization found to have posted false or misleading information will be banned from further use of this site. Nevertheless, donors are strongly encouraged to perform their own due diligence on the organizations and projects they find in the Charity Factors website, bearing in mind that these organizations and projects are not "approved" by Charity Factors nor has their authenticity been validated in any way by us. Possible investigative steps you may want to consider include:

You could contact the organization directly by phone or e-mail, requesting more detailed information and historical data. You may also wish to ask for references or other proof of their work.

You could contact a trusted associate (particularly in the country of origin or someone who has close ties to or knowledge of that particular country and/or cause) to further research your findings.

You could contact your professional advisor or tax accountant to help research or answer any questions you might have. Only once you have established the validity of the organization and the project should you contact the organization or project leader to discuss your donation.

You agree to conduct your own due diligence and that Charity Factors may not be held liable in any way for any counterfeit organization or project found on this site. Charities and non-for-profit organizations can have similar names: it is your responsibility to check that you are donating to the organization you intended.

Accounts.

• Acceptance Criteria. Any organization is invited to apply for a Charity Factors account on this site, provided it does not: a) Provide inaccurate information b) Impersonate any person or use a name not legally authorized to use c) Promote obscene or pornographic materials d) Promote violence e) Promote discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age f) Promote illegal activities g) Facilitate gambling, sweepstakes, lotteries or multi-level marketing schemes h) Solicit money or investment contrary to applicable law or rule i) State or imply that Charity Factors endorses its organization, its website or its contents j) Violate intellectual property rights. 

• Application. To begin the account registration process, you must submit a application via the CharityFactors website. We will evaluate the application and will notify you of its acceptance or rejection based on the above qualifications. Notwithstanding the above qualifications, we may refuse service to any organization without having to motivate or state any reason.

• Donations. In order to receive donations from website visitors, you must have your PayPal account. You can also choose to raise funds through Charity Factors Foundation. Charity Factors Foundation pools the contributions from each donor, and if the project has received $250 or more in funding, transfers the money either to the Organization. If Charity Factors Foundation directs the funds to the Organization overseas, bank wire transfer charges may apply. If the project has not yet reached $250, funds are disbursed once it has reached that amount.

• Responsibility to Maintain Fresh and Accurate Content. Information about your cause, which may include images, will be viewed by a wide audience of potential donors, most of whom would never have discovered your cause had they not logged onto this site. Because it is the desire of Charity Factors to maintain an accurate, up-to-date database of information, we rely on the integrity of all users to represent themselves honestly and accurately. Should any changes occur to the status of a cause, its leadership team, its vision and mission statement, its contact details, its banking details, its projects, or its administrators or authorized representatives, you agree, within five days of such changes, to log onto Charity Factors and revise the contents where applicable. Additionally, you agree to update your cause profile as it changes or becomes obsolete. You may update or change your content as often as you wish. 

• Responsibility to Prospective Donors. You and your cause should expect to be contacted by donors directly should they have further interest or additional questions not answered in the original content provided. 

Copyright Infringement and DMCA Policy. As Charity Factors asks others to respect its intellectual property rights, it respects the intellectual property rights of others. If you believe that material located on or linked to by Charity Factors violates your copyright, you are encouraged to notify Charity Factors via e-mail support[at]CharityFactors.com You agree to receive periodic e-mail announcements from Charity Factors on policy changes, software updates, and/or functionality enhancements. Knowledge  of these is required for proper use of Website. We respect your privacy. All notices will be sent by e-mail or will be posted on the Charity Factors web site. When providing notice by e-mail, we will send notices to you at the e-mail address maintained in user records. All users must monitor their e-mail messages frequently to ensure they are aware of any notices sent by us. 

Confidentiality. Unless required by law, you will treat Charity Factors’ intellectual property as confidential and proprietary, and not disclose them to anyone without Charity Factors’ prior written consent. You may not use Charity Factors’ trademarks and advertising without CharityFactors’ permission, and then only in ways agreed to by you and Charity Factors. Upon termination of this agreement, you will promptly return any of Charity Factors’ property in your possession.

Data. In order to provide the highest level of service to all Charity Factors users, data provided by you for processing will be combined with data from all Charity Factors users. The combined database will be used for risk analysis of user transactions. Ownership of the combined database remains with Charity Factors. Account’s information from Charity Factors’ database will not be provided to you or any other party during this agreement or upon termination of this agreement. Charity Factors, CharityFactors.com, Charity Factors’ international web sites, the Charity Factors’ logo, and all other trademarks, service marks, graphics and logos used in connection with Charity Factors, or the Website are trademarks or registered trademarks of Charity Factors or Charity Factors’ licensors. Other trademarks, service marks, graphics and logos used in connection with the Website may be the trademarks of other third parties. Your use of the Website grants you no right or license to reproduce or otherwise use any Charity Factors or third-party trademarks.

Changes. Charity Factors reserves the right, at its sole discretion, to modify or replace any part of this Agreement. It is your responsibility to check this Agreement periodically for changes. Your continued use of or access to the Website following the posting of any changes to this Agreement constitutes acceptance of those changes. Charity Factors may also, in the future, offer new services and/or features through the Website (including, the release of new tools and resources). Such new features and/or services shall be subject to the terms and conditions of this Agreement.

Termination. Charity Factors may terminate your access to all or any part of the Website at any time, with or without cause, with or without notice, effective immediately. If you wish to terminate this Agreement or your Charity Factors account (if you have one), you may simply discontinue using the Website. All provisions of this Agreement which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers,indemnity and limitations of liability. 

Disclaimer of Warranties. The Website is provided "as is". Charity Factors and its suppliers and licensors hereby disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose and non-infringement. Neither Charity Factors nor its suppliers and licensors, makes any warranty that the Website will be error free or that access thereto will be continuous or uninterrupted.

Limitation of Liability. In no event will Charity Factors or their suppliers or licensors, be liable with respect to any subject matter of this agreement under any contract, negligence, strict liability or other legal or equitable theory for: (i) any special, incidental or consequential damages; (ii) the procedure of procurement or substitute products or services; (iii) for interruption of use or loss or corruption of data. Charity Factors shall have no liability for any failure or delay due to matters beyond their reasonable control. The foregoing shall not apply to the extent prohibited by applicable law.

General Representation and Warranty. You represent and warrant that (i) your use of the Website will be in strict accordance with the Charity Factors Privacy Policy, with this Agreement and with all applicable laws and regulations (including without limitation any local laws or regulations in your country, state, city, or other governmental area, regarding online conduct and acceptable content, and including all applicable laws regarding the transmission of technical data exported from the United States or the country in which you reside) and (ii) your use of the Website will not infringe or misappropriate the intellectual property rights of any third party. 

Indemnification. You agree to indemnify and hold harmless Charity Factors, their contractors, and their licensors, and their respective directors, officers, employees and agents from and against any and all claims and expenses, including attorneys’ fees, arising out of your use of the Website, including but not limited to out of your violation this Agreement.

Miscellaneous. This Agreement constitutes the entire agreement between Charity Factors and you concerning the subject matter hereof, and they may only be modified by a written amendment signed by an authorized executive of Charity Factors, or by the posting by Charity Factors of a revised version. Except to the extent applicable law, if any, provides otherwise, this Agreement, any access to or use of the Website will be governed by European Union laws, excluding any possible conflict of law provisions, and the proper venue for any disputes arising out of or relating to any of the same will be the courts located in the Republic of Latvia.
